Part 3a - Terms of Reference and Scheme of Delegation

J. Executive Director (Services for Children and Young People)

  1. The appointment, in consultation with the Head Teacher, of Members of the teaching staff, not subject to the Local Management of Schools Regulations (other than the Head Teachers or Deputy Head Teachers).

  2. The admissions to Maintained County and Voluntary Controlled schools in Tameside of pupils resident elsewhere, and to schools elsewhere, of children resident in Tameside.

  3. The admission of pupils and students to Maintained County and Voluntary Controlled schools.

  4. The making of arrangements for the allocation of pupils to Maintained County and Voluntary Controlled schools.

  5. The administration and enforcement of legislation governing the employment of children and young persons in entertainment, part-time employment and street trading. 

  6. The payment, in accordance with approved schemes, of travelling expenses of pupils between home and school and the payment of maintenance grants.

  7. The granting, in accordance with approved schemes, of temporary allowances to teachers not subject to the Local Management of Schools Regulations undertaking the duties of Head or other teachers holding a post of responsibility where that person is absent for a prolonged period or where a permanent appointment to the post is delayed.

  8. In conjunction with the Borough Solicitor, the institution of legal proceedings relating to school attendance (after consultation with the Attendance Panel where appropriate).

  9. The granting of applications for free meals, milk and clothing.

  10. The assessment of, making and maintenance of statements of the special educational needs of children, and the approval and making of arrangements for special education and for home tuition or other provision for pupils.

  11. The power to approve the granting of easements affecting school land, on terms and conditions negotiated or to be negotiated by the Executive Director (Economy and Environment), provided that in the case of each application the Executive Director (Services for Children and Young People) shall consult the Governing Body and the Head Teacher of the school concerned with any cases of difficulty being referred for determination by the Cabinet Deputy (Lifelong Learning Services).

  12. To decide upon the suitability of a school in respect of the provision of school transport.

  13. The determination of approval for extended visit or visits involving travel by air or sea, hazardous activities taking place within one day or educational visits abroad.

  14. To confirm special admission arrangement agreements with Governors of Voluntary Aided and Special Agreement Schools under Section 30 of the Education Reform Act 1988 where no accommodation shortage would result.

  15. In conjunction with the Borough Treasurer, the granting of applications for premature retirement and added years for teaching staff not subject to the Local Management of Schools Regulations providing that applications are within the Council’s Early Retirement Scheme.

  16. In consultation with the Cabinet Deputy (Lifelong Learning Services), the appointment of Local Education Authority Governors

  17. To take the necessary action to ensure the safeguarding of children in all educational provision, whether pre-school day care, primary, secondary or residential schools, or out of school activities, youth work, play, childcare and family learning.

  18. To take the necessary action to ensure all schools and educational services have policies and procedures for child protection and to ensure the Local Education Authority is a core Member of the Local Safeguarding Children Board and that maintained schools, staff and governors and other direct educational provision are fully integrated in and familiar with, child protection procedures.

  19. To take the necessary action to ensure measures are in place to promote good attendance; to provide effective personal, social and health education; support for family learning; opportunities for personal and social development, and support for the voice of young people and children, with specific attention given to groups at risk of low achievement, including children in public care, with special needs, and particular ethnic groups; the attendance, behaviour and provision for pupils out of school, within the context of a general approach to educational inclusion

  20. The assessment and payment of mandatory awards to students in further and higher education.

  21. The assessment and payment with approved schemes and discretionary awards to students in further and higher education.

  22. To implement contractual arrangements in respect of catering services for school meals.

  23. The control of visits to and contact with children in the Children's homes, provided by the Council and the giving of all necessary consents in relation to the education, religious and cultural education, emigration, medical treatment (including operations), absence abroad on holiday, adoption of careers, marriage, termination of pregnancy in respect of children under the age of 16 and subject to Care Orders, and all other similar matters relating to children looked after by the Council.

  24. The review of the welfare, health, education, conduct and progress of Children Looked After by the Council under the Children Act 1989.

  25. The making of grants to children or their relatives, foster carers and prospective adoptive parents, according to the special needs involved to a maximum to be decided from time to time by the Council.

  26. The giving of approval to residence at their homes of children subject to Care Orders to the local authority for trial periods, the giving of approval of the placement of children with the agreement of the child’s family, the residence of children elsewhere on holiday and their placement in accommodation to meet their special needs (including authority to apply for Secure Accommodation Orders as necessary).

  27. The investigation of cases, and in consultation with the Borough Solicitor, the commencement of proceedings, appearances before a Court as appropriate, the making of applications and representations and the imposition of requirements in relation to any of the matters within the warrant of Cabinet Deputy (Lifelong Learning Services).

  28. To take any action which is calculated to facilitate or is conducive or incidental to the discharge of functions in accordance with the Childrens Act 2004 and to comply with requirements imposed by legislation.

  29. The making of arrangements with, or contributions to, non-statutory organisation and other local authorities providing residential or temporary accommodation to children or young people.

  30. The administration of services for the welfare of sight and hearing impaired children/young people, with mental health problems, with disabilities, and carers including, in particular, the recovery (in consultation with the Borough Treasurer and Borough Solicitor) of such charges as may be determined from time to time by the Cabinet Deputy (Lifelong Learning Services).

  31. The management of the youth service including the development and allocation of youth facilities and youth provision.
