Beware Data Protection Agencies

A number of companies calling themselves Data Protection Agencies or similar are targeting businesses and organisations nationwide such as local Government offices with mailshots, requesting that they register through them with the Information Commissioner in accordance with the Data Protection Act 1998.

The above agencies are charging a minimum of £95 and are not making it clear to those receiving the mailshots that they can notify with the Information Commissioner directly for a fee of £35.

Most organisations that process personal data may be required to register with the Information Commissioner under the Data Protection Act 1998. However, small businesses that process personal data for limited purposes may not have to register. The tactics used by these agencies have recently been exposed via the media. There are a small number of these agencies in Tameside and Trading Standards are working with the Office of Fair Trading in order to crack down on any misleading advertising that is being used.
