Gating Order for Certain Highways for the Purposes of Preventing Crime and/or Anti-social Behaviour

Laburnum Road to Ash Road, Denton Gating Order 2013

This Order is made by the Tameside Metropolitan Borough Council, under the Highways Act 1980, Section 129A ("the Act") as highway authority for the highway indicated below because it appears that:-

  1. the requirements of Section 129A(3) in respect of the said highways are satisfied; and
  2. that it is expedient for the purposes of preventing or reducing crime and/or anti-social behaviour that public pedestrian use of the said highways be restricted as this Order provides.

By This Order

  1. The public pedestrian use of the highways indicated in paragraph 1 of the Schedule below should be restricted;
  2. That such restriction should apply at all times; and
  3. That such restriction shall not apply to those parties whose interests would otherwise be affected by this Order and whose interests are identified as those protected by Section 129B (3), (4) and (5) of the said Act as amended; and
  4. That the alternative route is as indicated in paragraph II of the Schedule below.

The Schedule

  1. The routes to be restricted are the full lengths and widths of definitive footpath 76 from the side of number 176 Laburnum Road (Point D on the map) to the side of number 185 Ash Road (Point G on the map), definitive footpath 77 from the side of number 138 Laburnum Road (Point C on the map) to the side of number 147 Ash Road (Point H on the map), definitive footpath 78 from the side of number 108 Laburnum Road (Point B on the map) to the side of number 117 Ash Road (Point I on the map), and definitive footpath 79 from the side of number 76 Laburnum Road (Point A on the map) to the side of number 85 Ash Road (Point J on the map) as shown by bold continuous lines on the Order map.
  2. The alternative route which will be available to pedestrian traffic, if the Order is made, is located on as much as is necessary of the southern pavement of Laburnum Road, southern pavement of Manchester Road, eastern pavement of Balmoral Drive and northern pavement of Ash Road as shown by a bold broken line on the Order map.
