Tameside Adults Safeguarding Partnership Board

In response to the Care Act 2014, each local authority has a Safeguarding Adults Board (SAB). In Tameside this is the Tameside Adults Safeguarding Partnership Board (TASPB).

The board assures itself that local safeguarding arrangements and partners act to help and protect adults in its area from abuse who meet the criteria as defined:

has needs for care and support (whether or not the local authority is meeting any of those needs).

and

is experiencing or at risk of abuse or neglect.

and

As a result of those care and support needs, is unable to protect themselves from either the risk or the experience of the abuse or neglect.

The safeguarding duties apply to an adult who is over 18.

Our Commitment

TASPB recognise that the abuse of adults is a reality. The board do not believe it is acceptable and are committed to partnership working to prevent and stop both the risks and experience of abuse or neglect.

They will ensure that the safeguarding arrangements:

Promote the adult’s well-being.
The staff in their organisations work with the person to establish what being safe means to them and how best this can be achieved.
Staff are trained to be alert in detecting signs or symptoms of adult abuse.

The partnership is also responsible for writing annual reports on a yearly basis to show activity and progress to date.

TASPB and the Freedom of Information Act (2000)

The Freedom of Information Act 2000 (FOI) gives the public a general right to access information held by public bodies, including local authorities, the NHS, the police and state funded schools.
The Tameside Adult Safeguarding Partnership Board (TASPB) is a statutory partnership established under the Care Act 2014. However, TASPB is not classed as a public authority for the purposes of the FOI Act, meaning the Board is not legally required to provide information in response to FOI requests.

Why we are not subject

Section 3 of the FOI Act states that information is only considered held by a public authority if: it is held by the authority for its own purposes, or

it is held by another organisation on behalf of that authority.

As TASPB is not a public authority, it does not hold information for its own purposes under the FOI Act.
Partner organisations may hold TASPB-related information on behalf of the Board, such as minutes, reports or documents. This information is therefore not subject to disclosure, even if the partner agency itself is a public authority.

Requesting FOI’s from partner agencies

FOI requests may still be made directly to partner agencies where they hold information for their own operational purposes, and such information will be subject to FOI.

However, when a partner agency holds TASPB material (for example board minutes or reports), they are holding this on behalf of TASPB, and therefore that material is exempt from FOI disclosure.
